GUEST REGISTRATION, TERMS AND CONDITIONS OF RESIDENCE

These terms and conditions apply to all guests, occupants and visitors entering or staying at Ingaadi Spa & events. The registered guest accepts responsibility for ensuring that all members of their party and their visitors comply with these terms.

1. Guest responsibility

1.1 The person signing this agreement confirms that they are authorised to accept these terms on behalf of all persons included in the booking.

1.2 If the person signing is not authorised to act on behalf of another person, they agree to be personally responsible for all accommodation charges, additional services, losses, damage and other amounts arising from their stay or the stay of any member of their party.

1.3 The registered guest is responsible for the conduct of all occupants and visitors associated with the booking.

1.4 Only registered guests may occupy the room or unit overnight. The maximum occupancy specified in the booking may not be exceeded without prior written approval from management.

1.5 Guests under the age of 18 must be accompanied and supervised by a responsible adult.

2. Payment and rates

2.1 A full prepayment is required to secure a reservation, unless otherwise agreed in writing.

2.2 Ingaadi Spa & events applies a strict no-pay, no-stay policy. All outstanding amounts must be paid before check-in or before any extension of a stay is approved.

2.3 Rates are quoted in South African rand per room or unit, per night or per month, as applicable. Rates include VAT where applicable.

2.4 Published rates may be amended without notice. However, the rate for a confirmed and fully paid reservation will remain as agreed unless the booking is subsequently changed by the guest.

2.5 Credit cards, debit cards and electronic funds transfers are accepted.

2.6 Any additional services or charges, including laundry, late check-out, damage, replacement items or additional cleaning, must be settled before departure.

3. Cancellations, no-shows and early departures

3.1 In the event of cancellation, the following cancellation fees will apply:

  • More than 30 days before the scheduled arrival date: no cancellation fee.
  • Between 8 and 30 days before the scheduled arrival date: 50% of the total booking value.
  • Seven days or fewer before the scheduled arrival date: 100% of the total booking value.

3.2 A no-show will be treated as a cancellation made seven days or fewer before arrival, and a 100% cancellation fee will apply.

3.3 No refunds will be provided for early departures, unused nights or a reduced number of guests unless otherwise agreed in writing.

3.4 Cancellation fees will be applied subject to the Consumer Protection Act and any other applicable law. No cancellation fee will be charged where prohibited by law, including qualifying cases involving the death or hospitalisation of the person for whom, or for whose benefit, the booking was made.

3.5 Cancellations must be submitted in writing. A cancellation will take effect on the date it is received and acknowledged by Ingaadi Spa & events.

3.6 Where a booking was made through a third-party booking platform or travel agent, that provider’s cancellation and refund procedures may also apply.

3.7 Approved refunds will be processed using the original payment method where reasonably possible. Any permitted bank or transaction fees may be deducted from the refund.

4. Check-in and check-out

4.1 Check-in is from 14:00 on the day of arrival.

4.2 Early check-in is subject to availability, must be arranged with reservations in advance and may incur an additional charge.

4.3 Check-out is by 10:00 on the day of departure.

4.4 Late check-out is subject to availability and prior approval. An additional fee may apply and will be communicated to the guest before approval.

4.5 Check-out at or after 14:00 will be charged at the full nightly rate applicable to the room or unit booked.

4.6 An extension of stay is subject to availability. Guests should request an extension as early as possible. Payment for an approved extension must be made by 10:30 on the original departure date.

5. Included and additional services

5.1 Short-term accommodation includes complimentary tea, coffee, sugar and milk, guest amenities, daily housekeeping, water, electricity and 24-hour security, subject to availability and circumstances beyond the reasonable control of Ingaadi Spa & events.

5.2 Additional services, including laundry, may incur an extra charge.

5.3 Irons and hairdryers are available on request. A fully refundable deposit of R200 per item is required.

5.4 The deposit will be refunded when the item is returned in the same condition in which it was issued. The reasonable cost of repairing or replacing a lost or damaged item may be deducted from the deposit.

6. Parties, noise and conduct

6.1 The accommodation may not be booked or used for parties, events, gatherings or commercial activities without prior written approval from management.

6.2 Ingaadi Spa & events is a noise-sensitive property. Guests must respect the privacy and comfort of other guests, residents and neighbours.

6.3 Quiet hours are from 21:00 to 07:00. During these hours, noise must be kept to a minimum.

6.4 Guests and their visitors may not engage in conduct that is excessively noisy, disruptive, threatening, offensive, dangerous or otherwise likely to disturb other guests or neighbours.

6.5 A substantiated noise complaint or serious disturbance may result in a charge of R1,000.

6.6 If the disturbance continues or occurs again after a warning, management may terminate the stay and require the guest, occupants and visitors to leave the property immediately. No refund will be provided for unused accommodation, to the extent permitted by law.

6.7 In cases of serious misconduct, violence, threats, unlawful activity or danger to any person or property, management may act immediately without first issuing a warning. Security services or the South African Police Service may be contacted where necessary.

7. Visitors and access control

7.1 A maximum of two visitors is permitted per room or unit at any one time, unless management has provided prior written approval.

7.2 Visitors must be collected from the gate by the registered guest they are visiting.

7.3 No new visitors will be admitted to the property after 21:00.

7.4 Visitors may not remain overnight unless they have been registered with and approved by management, and any applicable additional accommodation charges have been paid.

7.5 Registered guests may enter or leave the property using taxis, e-hailing services or other approved transport, subject to the property’s security and access procedures.

7.6 Guests are responsible for the behaviour of their visitors and for any loss, damage, disturbance or additional costs caused by them.

7.7 Management and security personnel may refuse entry to any unregistered, unidentified, disruptive or unauthorised person.

8. Smoking

8.1 Smoking and vaping are strictly prohibited inside all rooms, units and indoor common areas.

8.2 Smoking is permitted only in designated outdoor areas or on a private balcony where this is allowed and does not disturb other guests.

8.3 Smoking inside a room or unit will result in a charge of R500 per occurrence. Any additional reasonable cleaning, deodorising, repair or replacement costs may also be charged if they exceed this amount.

8.4 Cigarettes and other smoking materials must be extinguished safely and disposed of in the appropriate containers.

9. Pets and assistance animals

9.1 Pets are not permitted on the property.

9.2 A guest who requires an assistance animal should contact Ingaadi Spa & events before arrival so that reasonable arrangements can be made in accordance with applicable law.

10. Prohibited conduct

10.1 The following are prohibited:

  • Illegal drugs or unlawful activity.
  • Disorderly, abusive, threatening or violent conduct.
  • Tampering with smoke detectors, fire equipment, security equipment or access-control systems.
  • Bringing dangerous, flammable or hazardous substances onto the property.
  • Using rooms or units for any unlawful or unauthorised commercial purpose.
  • Causing deliberate or reckless damage to the property.
  • Interfering with the comfort, safety or privacy of another person.

10.2 Guests may not bring firearms or other weapons onto the property unless they are lawfully possessed, safely secured and disclosed where required by law.

10.3 A serious breach of this section may result in immediate termination of the stay and removal from the property without a refund, to the extent permitted by law.

11. Damage, breakages and additional cleaning

11.1 Guests are responsible for any loss, damage or breakages caused by them, members of their party or their visitors, excluding reasonable wear and tear.

11.2 Any damage, breakage, malfunction or safety concern must be reported to management as soon as it is discovered.

11.3 The guest may be charged the reasonable cost of cleaning, repairing or replacing damaged or missing property.

11.4 Where reasonably possible, Ingaadi Spa & events will provide supporting information, such as photographs, quotations or invoices, for material damage charges.

11.5 Guests may not remove furniture, linen, towels, appliances, decorations or any other property belonging to Ingaadi Spa & events from the room, unit or premises.

12. Keys, access cards and remotes

12.1 All keys, access cards, tags and remotes issued to a guest remain the property of Ingaadi Spa & events.

12.2 Guests must keep these items secure and may not provide them to unauthorised persons.

12.3 Lost, damaged or unreturned keys, cards, tags or remotes may be charged at the reasonable replacement cost, including any necessary lock or security-system changes.

13. Housekeeping, maintenance and access to rooms

13.1 Daily housekeeping is included for short-term stays unless the guest requests otherwise.

13.2 Guests should secure valuables and personal belongings before housekeeping staff enter the room or unit.

13.3 Management and authorised employees may enter a room or unit:

  • To provide agreed housekeeping services.
  • To perform necessary maintenance or repairs.
  • To investigate a safety, security or serious house-rule concern.
  • In an emergency.
  • Where otherwise reasonably necessary for the operation or protection of the property.

13.4 Where circumstances permit, reasonable notice will be given before entry, except in an emergency or where there is an immediate safety or security concern.

14. Parking and vehicles

14.1 Vehicles must be parked only in designated parking areas and may not obstruct entrances, exits, driveways or emergency access routes.

14.2 Guests must comply with all security and parking instructions.

14.3 Vehicles and their contents are left on the property at the owner’s risk, subject to applicable law.

14.4 Ingaadi Spa & events will not be responsible for loss of or damage to a vehicle or its contents unless the loss or damage results from conduct for which liability may not legally be excluded.

15. Electricity, water, internet and service interruptions

15.1 Ingaadi Spa & events will take reasonable steps to provide the services included in the accommodation rate.

15.2 Ingaadi Spa & events cannot guarantee uninterrupted electricity, municipal water, internet, television, mobile reception or other services where interruptions are caused by load shedding, municipal failures, network providers, severe weather or other circumstances beyond its reasonable control.

15.3 Guests must use water, electricity and other resources responsibly.

15.4 Any backup services or facilities provided remain subject to capacity, safety requirements and availability.

16. Lost property

16.1 Guests should check their room or unit carefully before departure.

16.2 Items left behind will be kept for up to three months from the date of departure, where reasonably practical.

16.3 Guests are responsible for arranging and paying for the collection or delivery of lost property.

16.4 Ingaadi Spa & events does not accept responsibility for loss of or damage to items left behind, except where liability may not legally be excluded.

16.5 Items not collected within three months may be donated, recycled or disposed of at the discretion of management, subject to applicable law.

17. Safety and emergencies

17.1 Guests must familiarise themselves with the emergency exits, fire-safety notices and emergency procedures displayed on the property.

17.2 Fire escapes, entrances and emergency routes must remain unobstructed.

17.3 Children must be supervised by a responsible adult at all times.

17.4 Accidents, injuries, suspicious activity, fire, water leaks, electrical faults and other emergencies must be reported to management immediately.

17.5 Guests must follow all reasonable safety and security instructions issued by management or security personnel.

18. Important limitation of liability

18.1 All persons enter and use the property and its facilities subject to the provisions of applicable South African law.

18.2 To the fullest extent permitted by law, Ingaadi Spa & events, its owners, employees and agents will not be liable for the loss of or damage to a guest’s personal belongings, valuables, vehicle or other property.

18.3 Guests are responsible for taking reasonable care of their belongings and are encouraged to keep valuable items secure.

18.4 Nothing in these terms excludes or limits liability for gross negligence, unsafe or defective facilities, or any other liability that may not legally be excluded or limited under the Consumer Protection Act or other applicable law.

18.5 Any unusual or property-specific safety risk that could result in serious injury or death must be separately brought to the guest’s attention. The guest may be required to sign or initial a separate risk notice confirming that it was explained and understood.

19. Right to refuse admission or terminate a stay

19.1 Management may refuse admission or terminate a stay where a guest, occupant or visitor:

  • Fails to pay an amount when due.
  • Provides false or misleading booking information.
  • Exceeds the permitted occupancy.
  • Seriously or repeatedly breaches these terms.
  • Engages in unlawful, dangerous, threatening or disruptive conduct.
  • Creates a health, safety or security risk.
  • Refuses to comply with a reasonable instruction from management or security personnel.

19.2 Any refusal of admission or termination of a stay will be exercised reasonably and subject to applicable law.

20. Personal information and privacy

20.1 Ingaadi Spa & events may collect and process personal information necessary to administer the booking, receive payment, provide accommodation, maintain security, comply with legal obligations and communicate with the guest.

20.2 Personal information may include identification and contact details, booking information, payment records, vehicle information and security footage where CCTV is in operation.

20.3 Personal information will be processed and protected in accordance with the Protection of Personal Information Act.

20.4 Guest information will not be used for direct marketing without an appropriate lawful basis or consent, where consent is required.

20.5 Guests may request access to or correction of their personal information by contacting Ingaadi Spa & events.

21. Complaints

21.1 Guests should report any complaint, defect or service concern to management as soon as reasonably possible during their stay.

21.2 Ingaadi Spa & events must be given a reasonable opportunity to investigate and address the matter.

21.3 Reporting a complaint only after departure may limit the property’s ability to investigate or remedy the issue.

22. General provisions

22.1 These terms are governed by the laws of the Republic of South Africa.

22.2 Nothing in these terms limits any right or remedy that a guest has under the Consumer Protection Act or other applicable law.

22.3 If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.

22.4 A failure by Ingaadi Spa & events to enforce a provision on one occasion does not prevent it from enforcing that provision in the future.

22.5 These terms should be read together with the guest’s booking confirmation, agreed rate and any property-specific safety notices.
